What to Expect

In a Chapter 13 bankruptcy, we will help you establish a plan whereby you make payments on a monthly basis for up to sixty months to a case administrator known as a Trustee. Depending on your situation, you may be required to pay only a fraction of your total debt. We can help you understand whether Chapter 13 bankruptcy is right for you.

Why Chapter 13 Bankruptcy

This form of bankruptcy may be right for you for any number of reasons. You may not qualify for Chapter 7. You may have debts, such as child support arrearages and IRS debt that cannot be discharged in Chapter 7. You may have filed for bankruptcy previously and be ineligible for Chapter 7. Finally, Chapter 13 bankruptcy might be the right choice for you if you want to make up arrearages on your home and stop a foreclosure.

If you own a home, and simply need time to make up missed payments while resuming your normal monthly payment, this plan allows you to make up the missed payments over a period of 36 to 60 months.
